Marijuana proponents allege that the U.S. government is exhibiting hypocrisy by owning a cannabis-related patent while also denying marijuana’s rescheduling.
Justice for some, which is justice for none by definition (because justice requires fairness) is the hypocritical function of law.
Our patent system is terribly broken (or so I have been told), and sometimes terribly questionable.
I understand the need and justification for someone to secure their hard investment (in time, energy, and money) to prevent someone else from simply stealing the result for profit. That is the legitimate reason for a patent system.
But where is the justice in patent trolling, which merely serves to hinder technological progress for selfish profit?
Where is the justice in allowing patents to be leveraged to enrich pharmaceutical executives at the severely high cost against people needing (but unable to afford) life-saving drugs?
I am not an expert on patents, but past queries towards such legal expertise revealed a broken system where it could take many years to secure a patent due to the bogged down nature of the patent system (and I have no reason to believe that has changed).
To perhaps relieve the burden upon the patent system (drum roll)…
Patent abuse should be illegal.
By the very rules of a patent, anyone securing one should be obligated to build a business around that patent (or lose it to the public domain) and be unable to secure more than a certain number of patents within a certain time frame to minimize, if not eliminate, patent trolling.
Anti-competitive laws are not being applied in the medical industry, so rampant price-fixing is horribly occurring, which means “free” healthcare is a horrible illusion. Patents involving life-saving anything should automatically invoke new patent rules to allow market competition for fair pricing to ensure the best price is available for relevant sufferers and charities helping any of those sufferers unable to cover even that cost.
Any fool believing in the ability to get rich off of the suffering of the masses fails to understand the needs of a balancing reality (suffering out is suffering in, by any intelligent reasoning — what I call the Rule of Reality), but I somewhat digress.
Improving the patent system obviously requires an efficient governmental system truly committed to public care, and not one leveraging law to pathetically secure power even for people clearly undeserving of such power (apparently even until oppression do “We the people” part).
The aforementioned points also obviously painfully applies to cannabis/marijuana.
Patent trolling of cannabis compounds and quality strains would basically be a disaster in the cannabis marketplace (costs on the business and consumer sides would rise amid expensive licensing agreements, ample legal conflicts due to patent research mistakes and confusion, exclusivity locking out perhaps better professional growers, and so on), as would be the ability to abusively patent medically necessary cannabis products.
Patent abuse is a form of law abuse, and law abuse is logically the worst form of abuse due to its mainly broad scope of destruction. It also happens to be the form of abuse that our nation was supposedly progressively established against, but pre-American law abusers across the political spectrum have continued to allow hypocrisy (in the form of discrimination as mass rights infringement) to actually govern our society to exacerbating degradation.
Is there anyone in the “land of the free” and “home of the brave” willing to readily identify the severe risk and danger from law abuse (which is rampant to the point where nobody in the oligarchy spanning the private and public sectors is facing prosecution for demonstrably severe fraud, national security violations, effectively if not outright bribery, and so on)?
I am, but I obviously cannot do it alone. The masses are the true drivers of society (the big “secret” that the oligarchy wants you to ignore), but the masses must understand that severe risk and danger in a way demanding sufficient mass organization (initially with educational unity, which invokes my role as a responsible entertainer here) for the maturely applied and successful pressures on behalf of justice for all.
